Terms of Service — Stoned Company Lda.

Welcome to Stoned! By using this website and by making purchases for delivery or for in-store pickup, you accept the terms and conditions below. Please read them carefully before placing an order.
1. Acceptance of the terms
By accessing, browsing and using the Stoned Company Lda. website, you agree to comply with these terms. If you do not agree with any of them, you should not use our services.
2. Customer account
You can buy without creating an account. If you create one, you undertake to provide true and up-to-date information and to keep your password confidential. Let us know immediately if you suspect unauthorised use of your account.
3. Products and prices
Description: we make every effort to describe our products accurately, but there may be minor errors or differences from the images.
Prices: prices include VAT and may change without prior notice. The price charged is the price shown at the time of purchase.
Availability: products are subject to stock availability. If a product you have ordered is not available, we will contact you to offer an alternative or refund the amount paid.
4. Payments
We accept card, MB WAY, Multibanco and other methods, through Viva.com's secure payment service. Payment is made at the time of purchase.
5. Shipping and in-store pickup
Purchases can be shipped or collected from the physical shop, Stoned Cannabis Store Machico, Rua General António Teixeira de Aguiar, 87-89, Loja H, 9200-106 Machico. Orders for pickup are ready in about 1 hour, within shop opening hours, and we notify you by email. To collect, show your order number; if someone else collects on your behalf, they must also bring an authorisation from you. We hold the order for 5 working days; if it is not collected, we cancel the order and refund the amount paid. Shipping conditions are set out in the Shipping Policy.
6. Withdrawal, exchanges and returns
You have 14 days to withdraw from a purchase made on the website, under the terms of the Returns and Refunds Policy, which forms part of these terms.
7. Guarantees
All products carry a 3-year legal guarantee of conformity (Decreto-Lei n.º 84/2021). If a product is defective, contact us to make a claim under the guarantee.
8. Use of products
Products are intended exclusively for the purposes stated on their packaging and in their descriptions. Stoned Company Lda. accepts no liability for damage resulting from improper use, without prejudice to your statutory rights as a consumer.
9. Privacy
The collection and use of your personal data are governed by our Privacy Policy, which forms part of these terms.
10. Changes to the terms
We may change these terms. Changes are published on this website and apply to orders placed from that date onwards.
11. Governing law and dispute resolution
These terms are governed by Portuguese law. The courts of the Judicial District of Madeira (Comarca da Madeira) have jurisdiction, without prejudice to the statutory provisions protecting consumers.
In the event of a consumer dispute, you may refer it to the Madeira Consumer Dispute Arbitration Centre (Centro de Arbitragem de Conflitos de Consumo da Madeira – CACCRAM), the competent body: Rua Direita, n.º 27, 1.º Esq., 9050-450 Funchal, telephone 291 215 070, email centroarbitragem.srem@madeira.gov.pt. Recourse to CACCRAM is voluntary and free of charge. For disputes of up to €5,000, if you choose arbitration, the shop is obliged to accept it. You may also use the Electronic Complaints Book (Livro de Reclamações Eletrónico) at livroreclamacoes.pt.
